1. Permitted Use

Unless you are a real estate, finance or lending professional using the Services in your professional capacity, you agree to use Shary Services for personal purposes only. Any commercial use by you must be limited to transactions carried out on your own behalf.

For real estate or finance professionals, commercial use of the Services is limited to providing information to consumers through the Platform or taking actions on behalf of a client, such as listing a property for sale.

Lending professionals and financial institutions may not use information provided by Shary through the Services to make decisions regarding loan approval, rejection or lending terms.

Subject to the restrictions set out in these Terms, you may copy information from the Services only where necessary for your personal use, including viewing, saving, printing or sending such information by email or other communication methods.

Otherwise, you may not reproduce, modify, distribute, display, provide access to, create derivative works from, decompile or reverse engineer any part of the Services.

You also agree not to provide, publish or authorise links to any Shary Services, including profile pages, through third-party websites unless such use is expressly permitted by Shary.

You may display or distribute derivative works based on Shary data only where Shary is clearly identified as the source.

2. Acceptable Use

You agree not to use the Services in any manner that:

• Violates any applicable law or regulation.

• Causes or may cause harm to Shary, its service providers, suppliers or other users.

• Involves sending spam or unsolicited communications.

• Includes chain letters, pyramid schemes or similar communications.

• Involves impersonating another person.

• Misrepresents your relationship or affiliation with another person or entity.

Except where expressly stated in these Terms of Use, these Terms do not grant you any licence to use, reproduce, distribute, display or provide access to any part of the Services through third-party websites, applications or platforms.

You also agree that you will not, and will not permit or encourage any third party to, reproduce, publicly display or otherwise make available any content accessible through Shary Services on or through another website, application or service.

This includes, without limitation:

• Reviews and ratings.

• Profile information.

• Information about real estate, lending or other professionals.

• Property images.

• Property listing details.

• Any other data or content available through the Services.

3. Automated Queries

Automated queries or tools used to obtain information from Shary Services are strictly prohibited unless you have obtained the prior express written permission of Shary.

This includes, without limitation:

• Screen scraping.

• Database scraping.

• Spiders.

• Robots.

• Crawlers.

• Any other automated activity or tool intended to collect or extract information from the Services.

As a limited exception, publicly available search engines and similar internet navigation tools may access the Services to create an index containing links to web pages only to the extent permitted by applicable law and copyright regulations.

Search engines and automated tools may not attempt to access information protected by security verification systems such as CAPTCHA or bypass any technical measures designed to restrict automated access to the Services.

4. Your Submissions, Account Use, Privacy and Third-Party Websites

For any material, information or content that you post or otherwise submit to Shary in connection with the Services, referred to as your “Submission”, you grant Shary, to the maximum extent permitted by law, a worldwide, perpetual, irrevocable and royalty-free licence to use such content.

This licence includes the right to:

• Transmit it.

• Publicly display it.

• Reproduce it.

• Edit or modify it.

• Create derivative works from it.

• Incorporate it into other works or content.

• Translate it.

• Use it in connection with the Services or through other media.

• Sublicense these rights.

Shary will not be required to pay you any compensation for your Submission or for exercising any of the rights granted under these Terms.

Shary may also remove or modify any Submission at any time where it considers such action necessary or appropriate.

For each Submission, you represent and agree that:

• The information you provide is accurate and complete.

• You have all rights and permissions necessary to submit the content.

• You have the authority to grant Shary the rights described in these Terms.

• Shary’s use of the Submission will not infringe the rights of any third party.

• The Submission complies with these Terms of Use and applicable laws.

You are solely responsible for all materials, information or content submitted through your user account or otherwise made available by you through Shary Services.

You may not share your user account credentials with other persons, and you are responsible for all activities and actions carried out through your account.

Shary processes data and information relating to your use of the Services in accordance with its applicable Privacy Policy.

Certain Shary features may allow your Submission to be sent or distributed to third-party websites or services that are not directly controlled by Shary.

Shary is not responsible for third-party websites or services and makes no warranties or representations regarding their content, availability, functionality, privacy policies or terms of use.

You are responsible for ensuring that any content you submit or publish complies with the terms applicable to any third-party website or service. Your use of such third-party services is also subject to their own terms and privacy policies.
